The defendant must be detained for three and a half years
In the process around the train accident of Bad Aibling a judgment has fallen. The Great Criminal Court at the Traunstein district court sentenced the accused to three years and six months' imprisonment.
The district court Traunstein saw it as proved that the railway staff is guilty of negligent killing. In the clash of two trains on 9 February in Oberbayern, 12 people had died and almost 90 were injured in a life-threatening manner.
By way of derogation from the prosecution, the court sentenced the man to cases of negligent bodily harm because of 85 acts and not as accused of 89 acts. The court also ordered the continuance of the imprisonment for the accused who had been in prison since spring.
There had been little doubt at the time. Even the defenders of the accused dispatcher had conceded this in their plea. However, they consider a probation penalty sufficient. The prosecutor's office, however, had applied for four years' imprisonment. The maximum penalty for negligent killing is five years.
Distracted from playing, he had set several signals wrong in the signal box. Thus he sent both trains simultaneously to the single track. When he paused an emergency call, he also pressed a wrong key. The alarm did not reach the drivers. The frontal collision was then inevitable.
