Pegida founder Bachmann must pay a fine

Because of incitement to the people, Pegida founder Lutz Bachmann has to pay a total fine of 9600 euros. Before the Dresden District Court, both the defense and the prosecutor's office withdrew their appeal at the suggestion of the judge.

Thus the judgment of May of first instance is final. The Dresden District Court had at that time regarded it as proven that the founder of Pegida in September 2014 had cursed as a "Gelumpe", "Viehzeug" and "Dreckspack" on refugees and asylum seekers. He had attacked the human dignity of the refugees coming to Germany and aroused hatred against them, according to the ruling.

The sentence is made up of 120 daily sessions of 80 euros each. The amount of the daily rate depends on the monthly net income, converted to 30 days.
On the other hand, the number of daytime events reflects the amount of the penalty. If there are less than 90 days, one has - with the exception of - a non-criminal record.

In addition to the fine, Bachmann must bear the costs of the trial and the costs arising from the appeal.

Theft, drug trafficking, personal injury: Bachmann has many criminal records

Both prosecutors and defendants had appealed against the judgment at first instance. In the first trial, the prosecution had demanded seven months' imprisonment, while the defense pleaded for acquittal.

However, both sides had already accepted the conviction of incitement to the people before the new process. In the appeal procedure, therefore, it was only the punishment. Witnesses were not heard. In contrast to the first procedure, when the courtroom was full with Pegida supporters, there were hardly any spectators this time.

Martin Schultze-Griebler, the judge in charge of the regional court, gave a detailed account of Bachmann's previous criminal records. The 43-year-old has been condemned in far more than a dozen cases since the turnaround, including driving without driving, theft, drug trafficking and bodily injury. He served part of the sentences in prison.

Bachmann remained remote from the verdict

"Now we are dealing with a deed that moves in a different area," said Schultze-Griebler with a view to the incitement of the people. The judgment of the District Court was "well founded". He therefore proposed Bachmann's defender Katja Reichel and prosecutor Tobias Uhlmann to withdraw their respective vocations. Both of them followed, so that the verdict is now legally binding.

Bachmann himself, who has been living on the Spanish island of Tenerife for some time, did not stay away from the process. However, he still regularly appears at the annual Pegida demonstrations in Dresden. His defendant did not comment on his income situation. He is practically a "private" and receives support from private investors.

Since October 2014, Pegida has been going to the streets of Dresden almost every week, making a mood of Muslims, refugees, politicians and the media. Last Monday, according to the initiative "counted", up to 2200 followers of the xenophobic movement gathered in the city. At weddings, it was over 20,000.
